- POLICY ENFORCEMENT: UTPB police and UTPB Athletics reserve the right to refuse service to anyone at any time at the event. Inappropriate behavior will result in the permanent loss of all parking and tailgating privileges to UTPB events at the complex. At its discretion, UTPB police may terminate tailgate parties or take other appropriate actions toward individuals, groups or organizations whose conduct is in violation of or in conflict with the Freddyville Tailgating Policy. Failure to comply with directions from UTPB police or any UTPB administrator may result in eviction from the event and the complex, without a refund of charges for the event ticket or other services.
- TAILGATING TIMES: Entry to the parking lot will be permitted beginning at 10:00 AM for 6:00 PM start times. Entry times will be adjusted and posted on the athletic website if an earlier kickoff time is scheduled. The parking lot shall be cleared within one hour following the completion of the football game.
- RESPONSIBILITY: Individuals participating in tailgating activities (tailgaters) are responsible for the conduct of their guests.
- TAILGATE SPACE SIZE: Tailgate set up is limited to the spaces which have been purchased and may not extend beyond the designated area. Tailgaters utilizing recreational vehicles ("RVs"), buses, trailers, or box trucks shall not exceed the parking spaces purchased. Amenities such as grills and furniture must be utilized within your allotted space(s). Saving tailgating spaces for others ("staking ground") is prohibited at all times.
- SELLING AND SOLICITING: Any and all promotional activities, solicitation, or advertising displays conducted in the complex on the event day must be approved and contracted with UTPB Athletics. UTPB does not permit unauthorized soliciting or collecting of contributions, vending, distribution of fliers or other promotional/advertising materials in conjunction with its activities. Advertising, sponsorship, and/or sale of commercial logoed items is not allowed except as authorized by UTPB Athletics. Authorization does not grant the holder any right to display advertising, banners, signs or commercially logoed vehicles, or to distribute promotional items at the designated parking lot or elsewhere in the complex. Fans may be asked to remove inappropriate banners or signs. Violations of these restrictions may result in revocation of the holder's permit for current or future UTPB events.
- PORTABLE TOILETS: UTPB Athletics will provide a limited number of portable toilets inside the complex parking lots.
- CONSUMPTION OF ALCOHOL: UTPB Athletics, ECISD, and City of Midland shall not be held liable or responsible for any actions taken by the public or tailgaters while on ECISD and City of Midland property or in regards to alcoholic beverage consumption. Individuals are responsible for compliance with all local and state laws governing behavior and alcohol consumption.
- Alcohol possession or consumption is only allowed within the complex parking lot proper. Alcohol cannot be brought past the traffic barriers or into the ticket lines. Outside alcohol may not be possessed or consumed inside the stadium.
- The possession and use of alcoholic beverages must be in compliance with all local, state, and federal laws as well as the UT System and UTPB Code of Conduct.
- Nobody under the age of 21 is permitted to consume or possess alcohol.
- Both the sale of alcohol and the provision of alcohol to anyone other than your guests are prohibited.
- Individuals or groups may not allow unrestricted access to alcoholic beverages.
- Kegs of beer are strictly prohibited.
- No glass containers are permitted in the complex.
NOTE: It is imprudent to serve alcoholic beverages to anyone other than yourself and your immediate party. You may be liable for injuries to guests and others from serving alcohol, especially to a minor. If alcoholic beverages are served, tailgaters should also serve food and alternative beverages in the same location.
- TENT AND CANOPY POLICY: The tailgater is to ensure that tents and canopies are anchored appropriately by utilizing sandbags, water barrels or weights.
Unanchored tents/ canopies can easily be blown over and present a safety hazard and/ or may cause damage to property. Do not anchor by placing stakes. The use of stakes may result in the tailgater's loss of tailgating privileges and result in fines and bills for any damages. Any person damaging ECISD, City of Midland, or UTPB property will be responsible for the cost of repairs. Tents and canopies may not obstruct sidewalks, drive lanes, or pedestrian walkways. Tailgating amenities including furniture, grills, generators, or satellite dishes, may not obstruct sidewalks, drive lanes, or pedestrian walkways. ECISD, City of Midland, or UTPB are not responsible or liable for accidents, damage, loss, or theft of materials/items/personal property at any time. Tailgating set-up is limited to the spaces which you have been assigned.
- GRILLING: Groups may bring their own food and picnic items to their tailgate area. Grilling is permitted. All fires must be contained within grills. Extinguish charcoal fires thoroughly with water before leaving them unattended. At the conclusion of the cooking process, the tailgater must properly dispose of all combustible material. Do not put charcoals in any trash receptacle/bin/ dumpster at the complex. Be sure that charcoal from BBQ pits are cooled and taken with you, to be disposed of properly. Do not leave or dump charcoal, wood, or grease in the trash cans, or parking lots. Any person damaging ECISD, City of Midland, or UTPB property will be responsible for the cost of repairs; including damages to the parking lot.
- GRILLING GUIDELINES: Barbecue grills/smokers and/or deep fryers:
- are not allowed to be attached, connected, or in any way to be in contact with any vehicle;
- shall have lids or tops;
- shall be located a minimum 25 feet away from any building and shall not obstruct the ingress or egress from any building;
- shall not be located on any sidewalk;
- shall be located a minimum 5 feet away from vehicles and tents; and
- It is recommended that tailgaters have a fire extinguisher immediately available in case of fire.
- PROPANE GRILLS AND CYLINDERS: The maximum size propane gas cylinders allowed is 20 lbs. A maximum of one spare cylinder is allowed at any cooking location and shall be located a minimum of 5 feet from the cooking operation. While in use and in storage, propane gas cylinders shall be in the upright position or positioned so that the pressure relief valve is in direct communication with the vapor space of the cylinder. Shut off valves prior to disconnecting propane cylinders from barbecue grills/smokers and/or deep fryers. Propane cylinders shall be removed from grills prior to storing the grill. Grills shall be fully cooled prior to storage, then properly secured, and the area cleaned.
- GENERATORS: All generators should be equipped with a noise reducing device (manufacturer-approved cover or muffler). You should not be able to hear your generator much beyond the proximity of your tailgate site. Try to direct generator exhaust towards an open area like empty parking spaces or drive lane away from your immediate neighbor. Special care should be taken when managing fuel and extension cords affiliated with generators. Being a good neighbor is also recognizing and accepting the fact that you are in a community parking lot that is converted 6-7 weekends per year into tailgate area. Some people will be using a generator that will produce some noise. Please expect some noise, some BBQ smoke and extra traffic. We ask that you be reasonable in your expectations and tolerant of your neighbors. If we all follow this advice and are good neighbors and good Falcons, then we will be able to coexist and enjoy the tailgating experience together with few issues.
- PETS: Pets must be on a controlled leash and are not allowed to run freely in the parking lot. Animals shall not be left unattended or secured to ECISD, City of Midland, or UTPB property (fences, etc.). Pet owners are solely responsible for their pets and any damage or injuries that they may cause. Ill-behaved pets or ones deemed dangerous, intimidating or destructive will be evicted and banned from University property. Clean up after your pet.
- TRASH & CLEAN UP: Dispose of all trash in trash receptacles located in the tailgate area or pack it out. The disposal of grease, hot coals, or hazardous materials onto the complex grounds is prohibited. Failure to keep the area clean during your stay or leaving your site unclean when you leave may result in loss of tailgating privileges.
- GUEST CONDUCT: The close configuration of tailgate areas requires that all attendees be good neighbors and conduct themselves in a manner that provides for the comfort and enjoyment of all. The tailgater who was assigned the tailgating site is responsible for the conduct of their guests. UTPB Police and Staff reserve the right to refuse service and to evict anyone from the tailgating areas at any time—inappropriate behavior could result in the permanent loss of all parking and tailgating privileges.
- SECURITY & SAFETY: It is the responsibility of each tailgate party to secure tailgate items. Tailgaters should lock food, beverages and valuables out of sight in vehicles; extinguish all fires or flames; unplug electrical outlets; secure barbecue pits, chairs, and ice chests; and store beverages in locked containers. ECISD, City of Midland, or UTPB are not responsible or liable for accidents, damage, loss, or theft of materials/ items/personal property at any time.
- TRAFFIC CONTROL DEVICES & EVENT STAFF: Do not remove or move barricades, barrels, chains, cones, signs or any other traffic control device. Be courteous and respectful to all Parking & Transportation guards and event staff. UTPB reserves the right to refuse service or evict anyone at any time— inappropriate behavior may result in the permanent loss of all parking and tailgating privileges.
- LOST & FOUND: During and after the game all unclaimed items are to be turned over to the UTPB Police Department. You may contact them at 432-552-2786 if you have any questions.
- EMERGENCY INFORMATION: In case of an emergency, call 911. For non-emergencies call the University Police Department at 432-552-2786. With your cooperation and adherence to our tailgate guidelines and procedures, everyone can enjoy this pregame activity and the excitement of UTPB Falcons Football. Take pride in being a UTPB Falcons fan and be respectful of other fans, use good judgment and common sense.
- FIREARMS NOT ALLOWED: A firearm license holder commits a criminal offense if the license holder intentionally, knowingly, or recklessly carries a handgun under the authority of Subchapter H, Chapter 411, Government Code, regardless of whether the handgun is concealed or carried in a shoulder or belt holster, on or about the license holder's person on the premises where a collegiate sporting event is taking place.
